GENERAL TERMS AND CONDITIONS OF SALE (GTCS) – PARTNERS

PRÉAMBULE

These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) govern the use of the website Oupartirsurfer.com (the “Website”) operated by Fanny ROBIN (the “Operator”).
They define the rights and obligations of the partners (the “Partner”) and the Operator in relation to the marketing of services and products offered on the Website.
Any registration or collaboration with the Website implies full and unconditional acceptance of these GTCS.

ARTICLE 1 – PURPOSE

These GTCS set out the conditions under which the Partner may offer and sell their services through the Website, including surf trip packages, surf lessons, and other related services.

ARTICLE 2 – PARTNER SERVICES

The Partner agrees to provide accurate and up-to-date information regarding their offers and services.
They guarantee a high-quality welcome and service to customers originating from the Platform.
Offers are valid within the limits of availability displayed on the Website.

ARTICLE 3 – COMMISSION AND PAYMENT

The Partner agrees to subscribe to an annual flat-rate plan for an amount of €389 excluding VAT.
Payment of the plan shall be made under the following conditions:
Once the Partner’s profile has been completed and approved, they shall have 7 business days to settle the invoice sent by email.
An invoice will be issued to the Partner.

ARTICLE 4 – PARTNER OBLIGATIONS

The Partner agrees to:
Comply with the rates and conditions agreed upon with the Platform;
Provide services that meet the quality standards defined by the Platform;
Notify the Platform of any changes to their information.

ARTICLE 5 – LIABILITY

The Operator shall not be held liable for disputes between the Partner and their clients.
In the event of Website unavailability due to reasons beyond the Operator’s control, the Partner shall not be entitled to any compensation.

ARTICLE 6 – PERSONAL DATA

Personal information collected in the context of the partnership is processed in compliance with applicable data protection regulations.
The Partner has the right to access, rectify, and delete their data by contacting contact@oupartirsurfer.com.

ARTICLE 7 – TERM AND TERMINATION

The partnership is concluded for a period of one calendar year (from January 1 to December 31) from the date of contract signature.
An email will be sent in early December to confirm contract renewal.
In the event of non-compliance with obligations by either Party, the contract may be terminated by written notice.

ARTICLE 8 – APPLICABLE LAW AND DISPUTES

These GTCS are governed by French law.
In case of a dispute, the Parties agree to seek an amicable resolution before initiating any legal action.
Failing that, French courts shall have sole jurisdiction.
